Summary:
On June 9, 2022, the Arizona Medical Board, with the consent of Dr. Malcolm, made an Order for Surrender of License in which the Board accepted the surrender of Dr. Malcolm’s license. This Order was made in the context of unprofessional conduct by Dr. Malcolm, namely Dr. Malcolm having pled guilty to three counts of obtaining prescriptions of controlled substances by fraud, deceit or misrepresentation and for having failed to report the charges to the Arizona Medical Board within 10 days as required by Arizona law. The College was notified of this Order by a report from FSMB dated June 17, 2022.

Summary:
On February 17, 2022, the Medical Board of California, with the agreement of Dr. Malcolm, made a Stipulated Surrender of License and Disciplinary Order effective February 24, 2022 in which Dr. Malcolm surrendered his license to practice medicine in lieu of further disciplinary proceedings and lost all rights and privileges as a physician and surgeon in California. This Order was made in the context of Dr. Malcolm having pled guilty on February 24, 2021 on three felony charges in California of obtaining prescriptions of controlled substances by fraud, deceit or misrepresentation between January 2014 through August 2019, for which Dr. Malcolm was sentenced to two years probation with terms and conditions, including a prohibition from practising medicine in California while on probation unless permitted by the Medical Board. Thirteen causes for Discipline were put before the Medical Board of California, and admitted to by Dr. Malcolm as part of the Order: Criminal Conviction; Drug Related Conviction; Violation of Drug Statutes; Acts of Dishonesty or Corruption; Gross Negligence; Repeated Negligent Acts; Furnishing Drugs to an Addict; Furnishing Dangerous Drugs Without an Appropriate Exam; Self-Administration of Controlled Substances; Conviction of a Felony Involving the Use, Consumption or Self-Administration of a Controlled Substance; Making False Statements; Failure to Maintain Adequate and Accurate Medical Records; General Unprofessional Conduct.
The College was notified of this Order by a report from FSMB dated June 17, 2022.

On December 10, 2021, the Texas Medical Board and Dr. Malcolm entered into an Agreed Order of Voluntary Surrender in which Dr. Malcolm agreed to voluntarily surrender his Texas medical license in lieu of further disciplinary proceedings. This Order was made in the context of Dr. Malcolm having pled guilty to three counts of obtaining prescriptions for controlled substances by fraud/deceit. The College was notified of this Order by a report from FSMGB dated June 17, 2022.
