Summary:
On October 22, 2020, the Discipline Committee found that Dr. John Taliano committed
an act of professional misconduct, in that he engaged in sexual abuse of a patient; and
engaged in conduct or an act or omission relevant to the practice of medicine that,
having regard to all of the circumstances, would reasonably be regarded by members
as disgraceful, dishonourable or unprofessional.
Patient A
The Committee found that Dr. Taliano engaged in professional misconduct in that he
sexually abused Patient A by inappropriately touching his testicles and penis under the
guise of a medical examination, and that this also constitutes disgraceful, dishonourable
or unprofessional conduct.
The Committee also found that Dr. Taliano engaged in disgraceful, dishonourable or
unprofessional conduct by telling Patient “A” to “Drop his pants”, and by insisting on
examining Patient A despite his protestations and refusal of a genital examination.
Witness B
The Committee found that Dr. Taliano engaged in disgraceful, dishonourable or
unprofessional conduct by entering the shower of Witness B while naked and touching
Witness B’s penis, and by making a comment regarding Witness B's penis size in the
presence of others.
A penalty hearing is to be scheduled.

Specified Continuing Education and Remediation Program:
A summary of a decision of the Inquiries, Complaints and Reports Committee in which the disposition includes a Specified Continuing Education and Remediation Program (“SCERP”) is required by the College By-laws to be posted on the register, along with a note if the decision has been appealed. A SCERP is one of the dispositions that the College’s Inquiries, Complaints and Reports Committee may make in connection with a matter before it, and this disposition requires the member to complete an education and remediation program specified for the member. Summary of the Undertaking given by Dr. John Patrick Taliano to the College of Physicians and Surgeons of Ontario, effective November 29, 2018:
Dr. Taliano is the subject of a referral to the Discipline Committee into allegations of sexual abuse and/or in disgraceful, dishonourable or unprofessional conduct with respect to a patient, who was a minor at the time. As a result of the referral:
Dr. Taliano has agreed not to engage in any professional encounters, in person or otherwise, with any patient under eighteen (18) years of age, in any jurisdiction, unless the patient encounter takes place in the continuous presence of a monitor who is a regulated health professional acceptable to the College, and unless the other requirements provided in Dr. Taliano’s Undertaking with the College are fulfilled. For further clarity, Dr. Taliano has agreed not to be alone with any patient under eighteen (18) years of age during any professional encounter.
Dr. Taliano has agreed to post a sign in all waiting rooms, examination rooms and consulting rooms, in all Practice Locations, in a clearly visible and secure location, that states: “Dr. Taliano has agreed not to have professional encounters, in person or otherwise, with any patient under eighteen (18) years of age, unless in the continuous presence of a practice monitor acceptable to the College of Physicians and Surgeons of Ontario. Dr. Taliano has agreed not to be alone with any patient under eighteen (18) years of age during any professional encounter. Further information may be found on the College website at www.cpso.on.ca”.
