On June 1, 2018, Windsor Regional Hospital (“WRH”) notified the College of Physicians and Surgeons of Ontario, pursuant to s.33 of the Public Hospitals Act and s.85.5 of the Health Professions Procedural Code, Regulated Health Professions Act, that Dr. Albert Kadri’s privileges at WRH were suspended on an immediate mid-term basis, effective June 1, 2018.

On February 4, 2019, WRH provided an update to the College of its notice of June 1, 2018. The update notified the College, pursuant to s.33 of the Public Hospitals Act and s.85.5 of the Health Professions Procedural Code, Regulated Health Professions Act, that Dr. Kadri has not been re-appointed to the professional staff of WRH for the 2017/2018 and 2018/2019 credentialing years and that the suspension of his privileges will continue pending Dr. Kadri exhausting his rights of appeal under the Public Hospital Act.

Summary:

On April 6, 2023, the Tribunal found that:

1) Dr. Kadri engaged in disgraceful, dishonourable or unprofessional conduct in his disruptive conduct with the Windsor Regional Hospital (WRH) staff and administrators, in his communications and advocacy with patients, in inappropriately billing the chronic dialysis team fee under the Ontario Health Insurance Plan (OHIP) and in his inappropriate recruitment and misleading of a junior physician.

2) Dr. Kadri failed to maintain the standard of practice of the profession by continuing to fax orders to the WRH where he no longer held privileges, and by his late or non-referral of his patients to the WRH’s multi-care kidney clinic, contrary to the model of care.

3) Dr. Kadri failed to comply with the orders of the Inquiries, Complaints and Reports Committee (ICRC) by not providing the College with the required OHIP consent form in a timely manner, by not maintaining and providing the College with a patient log in a timely manner and by effecting patient transfers late and in a disorderly way.

4) Dr. Kadri is incompetent.

Following a penalty hearing, the panel reserved its decision on penalty. The panel’s reasons for decision on penalty were released on July 13, 2023. The Tribunal ordered that:
  • The Registrar revoke Dr. Kadri’s certificate of registration, effective immediately;
  • Dr. Kadri attend before the Tribunal to be reprimanded; and
  • Dr. Kadri pay costs to the College in the amount of $250,510 within 30 days of the date of this order.
