Summary of the Undertaking given by Dr. Ernest Honyu Chiu to the College of Physicians and Surgeons of Ontario, effective September 6, 2023:
A College investigation was conducted into whether Dr. Chiu engaged in professional misconduct and is incompetent including in relation to criminal charges. Dr. Chiu was criminally convicted of three (3) counts of Obtaining Sexual Services for Consideration from two persons under 18 years old, contrary to Section 286.1(2) of the Criminal Code of Canada, and two (2) counts of Obtaining Sexual Services for Consideration, contrary to Section 286.1(1) of the Criminal Code of Canada. In the face of this investigation, Dr. Chiu has agreed never to apply or reapply for registration as a physician in Ontario or any other jurisdiction.

Dr. Ernest Chiu was found guilty of the following offences:
1. 3 counts of Obtaining Sexual Services for Consideration from two persons under 18 years old, contrary to Section 286.1(2) of the Criminal Code of Canada.
2. 2 counts of Obtaining Sexual Services for Consideration, contrary to Section 286.1(1) of the Criminal Code of Canada.

SENTENCE: June 6, 2023
For the three findings of guilt under Section 286.1(2) of the Criminal Code: Global sentence of 18 months imprisonment , to be served concurrently, and satisfied by time served.
For the two findings of guilt under Section 286.1(1) of the Criminal Code: Conditional sentence Order for 15 months with conditions. 3 years probation with conditions.
Ancillary orders:
1. Comply with a DNA Order;
2. Prohibited from possessing weapons for 10 years (s. 109 Criminal Code);
3. Order to comply with SOIRA (Sex Offender Information Registration Act) for 20 years.
Probation conditions:
1. Keep the peace and be of good behaviour.
2. Appear before the court when required to do so by the court.
3. Report as the Court directs in person to a supervisor and thereafter report when required by the supervisor and in a manner directed by the supervisor.
4. Remain in Ontario unless you have prior written permission from the Court or the supervisor to leave the province.
5. Notify the court or supervisor in advance of any change of name or address and promptly notify the court or supervisor of any change in employment or occupation.
6. Report to a supervisor within 2 working days, or such longer period as the court directs, after the making of the conditional sentence order, and thereafter, when required by the supervisor and in the manner directed by the supervisor.
7. This home confinement condition will be in effect for the first 6 months of the sentence.
8. Remain in your residence or on the property of your residence at all times
EXCEPT
- between 8:00 am and 1:00 pm each Thursday for the purposes of buying groceries, banking and other necessities of life
- for any medical emergencies involving you or any member of your immediate family
- Pre-booked medical and dental appointments
- Medical appointments of your immediate family members with prior approval from your supervisor
- Meetings with counsel or to attend court or disciplinary proceedings
- For any other rehabilitative reason with prior approval of your supervisor, including counselling, education, employment training programs, social services support programs.
9. For the next 6 months of this Order, remain in your residence or on the property of your residence at all times daily between the hours of 11:00 pm and 6:00 am; for the final 3 months be subject to statutory conditions.
10.Do not contact or communicate in any way either directly or indirectly, by any physical, electronic or other means, with named persons or anyone you know who is or has been involved in the sex trade.
11.Do not be within 200 metres of any place where you know any of the named person(s) to live, work, go to school, frequent or any place you know the person(s) to be EXCEPT for required court attendances.
12.Do not communicate with any person for the purposes of obtaining sexual services for consideration.
13.Do not posses any weapon(s) as defined by the Criminal Code.
14.Take any counselling as directed by your supervisor and provide proof of compliance with such counselling as as may be required by your supervisor.
15.Do not access the websites Backpage.com, kijiji, craigslist, leolist or any website where sexual services are offered for sale.
