Undertaking by Dr. Gerard Martin Burke to the College of Physicians and Surgeons of Ontario. (Note: This is a summary of the undertaking. For the complete terms, contact the College’s Registration Department):
(1) I, DR. GERARD MARTIN BURKE, hereby resign from the College of Physicians and Surgeons of Ontario, effective immediately. (2) I hereby undertake not to apply or re-apply for registration as a physician or for a licence to practise medicine in Ontario or any other jurisdiction. (3) I consent to the terms of this undertaking being entered on the register as information that is available to the public. (4) I acknowledge that, in exchange for this undertaking, the College of Physicians and Surgeons of Ontario agrees to cease its current investigation of a public complaint and its Registrar’s investigation respecting my standard of practice for patient care. I also understand that there has been no finding of professional misconduct in relation to this investigation at this time. (5) I agree that, in the event that the College of Physicians and Surgeons of Ontario should become aware that I have either applied, re-applied or attempted to apply or re-apply for registration as a physician in any jurisdiction, the College shall, in its sole discretion, have the right to proceed with a disciplinary proceeding on the basis of a breach of this undertaking along with the right to proceed with the investigation and prosecution of the allegations referred to at paragraph (4). (6) I acknowledge that this undertaking is irrevocable.
